Tuscaloosa Child Pornography Lawyer

Helping You to Help Yourself

Possession of child pornography is a very serious charge in Alabama. If convicted, your name would go on the community notification list, which resulted from Megan's law. Officially known as the Sex Offender Registration Notification Act (SORNA) law, this is a serious consequence of a conviction and places a number of restrictions on your mobility and freedom.

In addition, a conviction could result in jail time as a child sex offender.

My name is Joel Sogol, and I have been a criminal defense lawyer since 1974. If you've been charged with this crime, you need an experienced Tuscaloosa child pornography attorney on your side.

As your attorney, I will typically seek a proactive approach. I have more success keeping clients out of prison, when the client is actively involved in helping themselves. That help begins on day one with a change of behavior and counseling or treatment. We work as a team — my client on the behavior side and myself on the legal side. Together, we can show the court that we take the charge seriously.

Unlike other crimes, there is no "lesser" child pornography charge. The result of a child pornography offense is either guilty or not guilty.

A child pornography charge can result from any hard copy photograph or electronic image on your phone or computer. If someone sent you a nude or partially nude photo to your phone, a sexting charge could result if that person was 17 or younger under Alabama law. For a federal crime, the age is up to 18 years. If a 17-year-old sent a sexting image to another 17-year-old, it is still child pornography under federal law.

Video of an underage person with nudity or engaged in a sexual activity is even more damaging. Under federal law, each image counts as one 'unit' on the charge. Because there are 30 frames per second in video, there are 30 units of pornography for each second of running video. If a child pornography video clip is a few minutes long, there are thousands of child pornography units in a short amount of time.

When there are a large number of pornographic images, the charge is usually pursued in federal court rather than state court.
