If a 17-year-old sent a sexting image to another 17-year-old, it is still child pornography under federal law.

Video of an underage person with nudity or engaged in a sexual activity is even more damaging. Under federal law, each image counts as one ‘unit’ on the charge. Because there are 30 frames per second in video, there are 30 units of pornography for each second of running video. If a child pornography video clip is a few minutes long, there are thousands of child pornography units in a short amount of time.

When there are a large number of pornographic images, the charge is usually pursued in federal court rather than state court.
