Tuscaloosa Drug Trafficking Lawyer

Drug Trafficking Is a Weighted Crime

One of the common misconceptions is that a drug trafficking charge must be related to distribution, or possession with intent to sell. In Alabama, this is a fallacy.

In Alabama, drug trafficking is based strictly on weight.

For example, if you have one ounce or more of any type of mixture of cocaine, it will be charged as cocaine trafficking because it is more than the weight limit. My name is Joel Sogol, and I am an experienced Tuscaloosa drug trafficking attorney.

Drug trafficking may be charged in state court for possession of the following:

  • Four grams or more of phencyclidine (PCP)
  • Four grams or more of lysergic acid diethylamide (LSD)
  • Four grams or more of morphine or opium
  • 500 or more pills or capsules of hydromorphone (Dilaudid)
  • 28 grams or more of 3,4-methylenedioxyamphetamine (MDA)
  • 28 grams or more of methamphetamine (meth)
  • 28 grams or more of cocaine or crack
  • More than 1 kilo or 2.2 pounds of marijuana

The most common drug trafficking charges in West Central Alabama are for marijuana, cocaine or meth. If there are drugs as well as money and firearms in the same location, the crime will usually rise to a federal criminal charge.

West Central Alabama OxyContin Possession Attorney

Drug trafficking for OxyContin could be charged with possession of a relatively small quantity of pills. Even though the substance itself is illegal, it is illegal to be in possession of it if it is not prescribed to you. You could also be charged with drug trafficking if you have an illegal quantity of Adderall that was not prescribed to you.

Drug Trafficking Legal Strategies

Every case is unique. As your drug crime criminal defense attorney, I will look at the facts of your case to determine our best course of action. Perhaps we can challenge the validity of a search warrant. Was the traffic stop legal if there was one? Was there an error in weighing the drugs? Can the charge be reduced to possession by re-weighing the drugs? Were all of the arrest procedures and chain of evidence followed properly?

There are a number of avenues that can be pursued with an experienced criminal defense lawyer. We will use any, or all of them.
